Welcome to NES & CO. Creative House. These Terms of Service govern your use of our website and your purchase of products and services from NES & CO. Creative House. By accessing our website, submitting a custom-order request, approving a design, or purchasing from us, you agree to these Terms.

1. Products & Custom Orders

NES & CO. Creative House offers custom, personalized, made-to-order, and ready-to-purchase products. Because custom products are created specifically for each customer, colors, placement, sizing, and appearance may vary slightly from digital mockups or photographs.

Customers are responsible for providing accurate names, wording, dates, sizes, colors, quantities, images, personalization details, and other information requested for an order.

2. Custom-Order Requests & Quotes

Submitting a custom-order request does not place an order, guarantee availability, or reserve a production date.

After reviewing a request, NES & CO. Creative House may provide a quote, invoice, design proof, payment instructions, or request additional information.

Pricing may vary based on product type, quantity, design complexity, customization method, materials, size, turnaround requirements, and other specifications.

3. Design Proofs & Customer Approval

When a design proof or mockup is provided, customers are responsible for carefully reviewing all details before approval.

Once a design has been approved, NES & CO. Creative House may begin production. Changes requested after approval may result in additional design fees, material costs, production fees, or delays.

NES & CO. Creative House is not responsible for spelling, sizing, color-selection, wording, or other errors that were submitted or approved by the customer.

4. Payments

Payment requirements will be communicated at checkout, on an invoice, or during the custom-order process. Unless otherwise agreed in writing, required payment must be received before production begins.

Orders are not considered confirmed until all required information and payment have been received.

5. Production Time

Standard production time for custom and made-to-order products is generally 10–15 business days, unless otherwise stated.

Production time begins after required payment, order details, artwork, and approvals have been received. Weekends and holidays are not considered business days.

Production time and shipping time are separate.

Rush service may be available for an additional fee and must be approved before the order is placed.

6. Cancellations, Returns & Refunds

Custom and personalized products are generally final sale once production has begun. Cancellation, return, exchange, and refund eligibility is governed by our Return & Refund Policy.

If NES & CO. Creative House makes an error or an item arrives damaged or defective, customers should contact us promptly according to the procedures in our Return & Refund Policy.

7. Customer-Supplied Merchandise

Customers may occasionally provide their own garments or other merchandise for customization when approved in advance.

Customization processes—including embroidery, heat pressing, DTF application, sublimation, vinyl application, and other decoration methods—can involve heat, pressure, needles, adhesives, inks, machinery, or other processes that carry some risk to the item.

NES & CO. Creative House will use reasonable care when handling customer-supplied merchandise. However, customers acknowledge the inherent risks associated with customizing items they provide. Any responsibility for loss or damage will be determined in accordance with applicable law and the circumstances involved.

8. Customer-Provided Artwork & Intellectual Property

By submitting a logo, photograph, artwork, trademark, name, phrase, or other material for reproduction, the customer represents that they own the material or have permission to use and reproduce it.

The customer is responsible for obtaining any necessary licenses, permissions, or authorizations.

NES & CO. Creative House reserves the right to decline any project we reasonably believe may violate intellectual-property rights or applicable law.

Original designs created by NES & CO. Creative House remain our intellectual property unless ownership or licensing rights are transferred through a separate written agreement.

Purchasing a finished custom product does not automatically transfer ownership of the underlying digital artwork, design files, embroidery files, templates, or other production files.

9. Product Appearance

We make reasonable efforts to accurately display product colors and designs. However, colors may appear differently depending on screens, materials, garment colors, printing methods, embroidery thread, lighting, and other factors.

Handmade and customized products may have minor variations that do not constitute defects.

10. Shipping & Delivery

Shipping, tracking, delivery, address errors, carrier delays, and related matters are governed by our Shipping Policy.

11. Pricing & Availability

Prices, products, materials, colors, sizes, and availability may change without notice. We reserve the right to correct pricing or listing errors and to decline or cancel an order when necessary. If payment has already been collected for an order we cannot fulfill, the appropriate amount will be refunded.

12. Website Use

You may not use our website or services for unlawful purposes, interfere with the operation or security of the website, attempt unauthorized access, or misuse website content.

13. Limitation of Liability

To the fullest extent permitted by applicable law, NES & CO. Creative House will not be liable for indirect, incidental, special, or consequential damages arising from use of our website, products, or services.

Nothing in these Terms excludes or limits rights or remedies that cannot legally be excluded or limited.

14. Privacy

Personal information submitted through our website is handled according to our Privacy Policy.

15. Governing Law

These Terms are governed by the laws applicable to NES & CO. Creative House's business operations and applicable federal law, without limiting any consumer rights provided by applicable law.

16. Changes to These Terms

NES & CO. Creative House may update these Terms from time to time. The version posted on our website at the time of an order will apply to that transaction unless otherwise required by law.
